Law No. 58/2019, of 8 August, hereinafter “LPDP” and the General Regulation on Data Protection (Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, in “GDPR”) ensure the protection of natural persons regarding the processing of personal data and the free movement of such data.

“Personal data” is any information, of any nature and regardless of the respective support, including sound and image, relating to an identified or identifiable natural person, so the protection does not cover the data of legal persons. An identifiable person is a person who can be identified directly or indirectly, namely by reference to an identification number or to one or more specific elements of their physical, psychological, economic, cultural, or social identity.

  1. PURPOSES OF PROCESSING PERSONAL DATA

The personal data that we process through the Website will only be used for the following purposes:

  1. Managing the hiring of services performed through the Website, such as scheduling meetings and requesting contact;
  2. Periodically send our electronic newsletters with news related to J+Legal’s practice and the sector to which it dedicates itself;
  3. Managing the applications submitted for the recruitment process, such as the analysis of the Curriculum Vitae and Cover Letters;
  4. Periodically send commercial and/or promotional information related to our services sector, unless the holder objects or withdraws his consent;
  5. Anonymous and aggregated analysis of the use of services, in order to identify user habits and trends of our users, with the aim of improving the services we offer and meeting the specific needs of our Users;

In case of contracting, the data collected on this Website, together with the other data obtained under the contractual relationship, will be used for the management of human resources, to ensure compliance with legal obligations and made available to the firm’s employees, when necessary for pursuing their professional activity;
  7. Compliance with national and international legal provisions, or executing an order of competent judicial authorities;
  8. Fulfillment of legal obligations, derived from applicable legislation on data protection, as well as for the exercise of the rights of the holders, in particular, the defense of a right during a judicial process.

J+Legal ensures the confidentiality of the data provided. However, although J+Legal collects and processes data in a secure manner, preventing their loss or manipulation, by using the most appropriate techniques for this purpose, it is important to bear in mind that data collection in open networks allows personal data to circulate without absolute security conditions, with the intrinsic risk that they may be seen and used by unauthorized third parties.

 

  1. LAWFULLNESS OF PROCESSING

J+Legal handles User data:

  1. when they declare their express and free consent to the processing of their personal data for certain purposes and/or,
  2. when necessary for the execution of a contract to which the data user is a party, or for pre-contractual arrangements at the User’s request;
  3. to comply with legal obligations to which J+Legal is bound;
  4. for the purpose of legitimate interests pursued by J+Legal or by third parties, unless the data subject’s interests, fundamental rights and freedoms prevail and require protection of personal data.

The User, in turn, guarantees that the information provided is true and accurate, complete and up-to-date, and is liable for any damage or loss which, directly or indirectly, may be caused as a result of the breach of this obligation.

If the data provided belongs to a third party, the User guarantees that he has informed the third party of this Privacy Policy and that he has obtained its authorization to provide his data to J+Legal.

 

  1. RETENTION OF PERSONAL INFORMATION

J+Legal keeps and processes your personal data for the period necessary or mandatory for the fulfillment of the purposes described above, applying criteria in accordance with applicable legal and regulatory obligations.

J+Legal keeps personal data in its systems in such a way that it is possible to identify the holders of such data, in accordance with the following criteria:

  1. for a period of time not exceeding the purposes for which they were collected, provided that legal or contractual obligations do not provide otherwise;
  2. to fulfill specific legal or contractual obligations;
  3. when applicable and legitimate, unless any request for opposition or deletion by the data subject.

In addition to communications made in compliance with legal obligations and J+Legal itself, personal data may be known, solely for the purposes indicated above and in accordance with the consent granted, by:

- employees and collaborators of J+Legal, in its capacity of authorized data subcontractor;– national and international companies belonging to the same group as J+Legal;

- authorities in general, administrations entities and public bodies, both national and international;

J+Legal has implemented appropriate technical and organizational security measures to ensure the security of personal data provided to it by the User, preventing their alteration, loss, treatment and/or unauthorized access, taking into consideration the nature of the data stored and the risks to which they are naturally exposed.

J+Legal, when accessing personal data, undertakes to:

  1. Store them with the appropriate technical and organizational security measures, which prevent alteration, loss, treatment or unauthorized access, taking into account the nature of the data, the possible risks to which they are exposed, and the state of technology;
  2. Use the data only for the purposes defined above;
  3. Implement security measures to protect our facilities;
  4. Ensure that the data is only processed by employees whose intervention is necessary to satisfy the data subject's request, who are bound by the duty of secrecy and confidentiality.

In the event that data is shared with third parties for the aforementioned purposes, they are bound by the obligation of confidentiality as set forth in this document.
